Please read these Terms of Use carefully before using this website or placing an order. By accessing or using the Rolling Hills Estate Winery website, purchasing wine, or enrolling as a Genesis Circle Member, you agree to be bound by these Terms of Use. If you do not agree, please do not use this website or place an order. We may update these Terms from time to time; changes will be effective when posted. Your continued use of the website or membership in the Genesis Circle following any update constitutes your acceptance of the revised Terms.
Legal Requirements
You must be 21 years of age or older to order or receive alcoholic beverages from Rolling Hills Estate Winery. By placing an order with Rolling Hills Estate Winery, you represent and warrant that you and the intended recipient are each at least 21 years of age. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from Rolling Hills Estate Winery are for personal consumption only and are not for resale.
Minimum Purchase
No minimum purchase is required.
States Authorized for Direct Shipment
Rolling Hills Estate Winery is currently authorized to ship wine directly to consumers in the following state(s): New York.
SHIPPING AND DELIVERY
Weather and Temperature
Wine is a delicate and perishable product, and extreme temperatures may affect its condition during transit. To help protect your purchase, Rolling Hills Estate Winery may hold shipments in our temperature-controlled cellar until conditions are appropriate for delivery. If you choose to proceed with shipment during periods of extreme heat or cold, you assume the risk of potential damage, and we are not responsible for, nor able to replace, wine affected by such conditions. Title to and responsibility for the wine passes to the purchaser at the time the order is transferred to the common carrier for delivery.
Carrier
Federal Express (FedEx) is Rolling Hills Estate Winery’s carrier of choice. Ground shipping is provided at current market rates.
Processing Times
All orders are generally processed and packed within 24–36 hours. During special promotions, holidays, and peak season, please allow up to 4 business days for processing. FedEx picks up
packages Monday through Friday. You will receive a tracking number once your shipping label has been created; please allow up to 24–48 hours for the tracking number to become active in the FedEx system.
Special Delivery Requests
We are unable to accommodate requests for specific delivery time windows.
Re-Directed Shipments
If you would like a shipment re-directed to a different address after it has been picked up by the carrier, please contact us at wine@rollinghillsestatewinery.com. An additional fee will apply for this service.
Delivery Attempts
FedEx may make up to three delivery attempts. After the final unsuccessful attempt, the package will be held at the local carrier facility for up to five days, available for pickup upon presentation of valid ID. If the package is not retrieved within that period, it will be returned to Rolling Hills Estate Winery.
If your shipment is being returned to us, please contact us at wine@rollinghillsestatewinery.com to arrange re-shipment. An additional shipping fee will apply.
RETURNS AND REFUNDS
We stand behind the quality of our wines and will replace or refund any bottle that is damaged, defective, or flawed. To request a replacement or refund, please contact us within a reasonable time of receipt at wine@rollinghillsestatewinery.com. We may request that the unfinished portion of the original bottle be returned for evaluation.
Due to the nature of alcoholic beverage regulations, we are only able to accept returns or offer refunds for wines that are damaged or determined to be flawed. Once approved, refunds will be issued to the original form of payment for the cost of the wine. Original shipping charges are non-refundable, except in cases where the product was damaged or flawed upon receipt.
We are not responsible for, and cannot accept returns or provide refunds for, wines damaged due to extreme weather conditions during shipment or for orders placed in error.

Rolling Hills Estate Winery is committed to providing a website that is accessible to the broadest possible audience, regardless of ability. We strive to improve accessibility and work toward conformance with the World Wide Web Consortium’s (W3C) Web Content Accessibility Guidelines 2.2 (WCAG 2.2) at the AA level, which are designed to make web content accessible to people with a wide range of disabilities.

MISCELLANEOUS
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any disputes arising under or related to these Terms of Use shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of New York.
Limitation of Liability
To the fullest extent permitted by applicable law, Rolling Hills Estate Winery’s liability to you for any claim arising out of or related to your use of this website or the purchase of wine shall not exceed the total amount paid by you for the order giving rise to the claim. In no event shall Rolling Hills Estate Winery be liable for any indirect, incidental, special, or consequential damages.
Entire Agreement
These Terms of Use, together with our Privacy Policy and any additional terms applicable to Genesis Circle membership, constitute the entire agreement between you and Rolling Hills Estate Winery with respect to your use of this website and purchase of our products, and supersede all prior or contemporaneous understandings, agreements, or representations.
Severability
If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed from these Terms. The remaining provisions shall continue in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms of Use shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Rolling Hills Estate Winery to be effective.
